3. Service Description
Naungan provides legal services related to pension and retirement matters in Malaysia, including provisions reviews, pension claim representation, and structured retirement protection arrangements. Our services are intended for individuals and families based in or connected to Malaysia.
We do not provide investment advice, financial planning services, or medical advice. Nothing on this website constitutes legal advice unless provided under a signed Engagement Letter.
4. Service Engagement
A legal engagement with Naungan is only formed when:
- We have carried out a conflicts check and confirmed we are able to act;
- The scope and fee have been agreed in writing (Engagement Letter); and
- Any required initial payment has been received.
Submitting a website enquiry does not create a legal engagement or lawyer-client relationship. We will confirm in writing once an engagement is formally established.
5. User Responsibilities
When using our website or engaging our services, you agree to:
- Provide accurate and complete information when enquiring or engaging our services.
- Not misrepresent your identity, circumstances, or the documents you provide.
- Not use this website for any unlawful purpose or in breach of applicable regulations.
- Notify us promptly if any information you have provided changes.
- Not attempt to access parts of this website you are not authorised to access.
6. Fees and Payment
Our current service fees are as follows:
- Provisions Review: RM 245
- Claim Representation: RM 730
- Full Retirement Protection: RM 1,630
All fees are quoted in Malaysian Ringgit (RM) inclusive of any applicable tax unless stated otherwise. A written fee estimate is provided before work begins. Additional costs (such as third-party filing fees) will be disclosed separately and agreed before being incurred.
Payment is accepted by bank transfer or cash at our office. We do not currently accept credit card payments. Fees are due as set out in your Engagement Letter.
Refunds: If we are unable to proceed with your matter after receiving payment for reasons within our control, we will refund the fee in full. Where work has commenced, any refund will be calculated proportionally to work not yet carried out.
7. Confidentiality
All information you share with us in the course of a legal engagement is subject to professional confidentiality obligations. We will not disclose your information without your consent except where required by law or our professional rules. Our approach to personal data is set out in our Privacy Policy.
8. Intellectual Property
All content on this website — including text, layout, and design — is the property of Naungan or its licensors. You may view and print pages for personal, non-commercial use only. You may not reproduce, adapt, or distribute content from this website without our prior written consent.
9. Disclaimers
This website is provided for general information purposes. Content on this site does not constitute legal advice and should not be relied upon as such. The outcome of any pension legal matter depends on individual circumstances, the applicable law, and the decisions of relevant authorities, and cannot be predicted or assured.
We make no representation that the content of this website is complete, current, or error-free. You use this website at your own risk.
10. Limitation of Liability
To the extent permitted by Malaysian law, Naungan's total liability to you in connection with any matter arising from these terms or from the services we provide shall not exceed the fees paid by you for the specific service giving rise to the claim.
We are not liable for indirect, consequential, or special losses, including loss of income or financial opportunity, arising from your use of this website or from our services, except where such liability cannot be excluded by law.
11. Termination
Either party may terminate a service engagement by written notice. If you terminate an engagement in progress, fees for work already completed are payable. If we terminate an engagement, we will give reasonable notice and provide you with the documents and information you will need to appoint alternative representation.
We may also terminate an engagement immediately where a conflict of interest arises or where we are professionally required to do so under the Legal Profession (Practice and Etiquette) Rules.
12. Governing Law and Disputes
These terms are governed by the laws of Malaysia. Any dispute arising from these terms or from our services shall be subject to the exclusive jurisdiction of the courts of Malaysia, seated in Selangor or Kuala Lumpur.
Before commencing formal proceedings, both parties agree to attempt to resolve any dispute informally by written correspondence. We will respond to any complaint within 10 business days.
13. General Provisions
- Entire agreement: These terms, together with any Engagement Letter, constitute the entire agreement between us for the relevant service.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce a right does not constitute a waiver of that right.
- Assignment: You may not assign your rights under these terms without our written consent. We may assign our obligations to a suitably qualified successor practice.
14. Changes to These Terms
We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of this website or our services after changes are posted constitutes acceptance of the revised terms.
